COUNCIL REORGANIZATION MEETING

JANUARY 6, 2014

 

I.         CALL TO ORDER:

The meeting was called to order by Mayor Rhome at 7:00 P.M.

            A.All New Council Persons Present Certificates ofElection

to Mayor

1.       Mayor Rhome asked Mr. John Severine to come forward.

The Mayor asked Mr. Severine (who has been elected to

serve on Council) to declare which position he would take:

A four-year term on Borough Council or a two-year term

on Borough Council.

Mr. Severine declared that he would take the four-year

term on Borough Council.

Mayor Rhome stated for the record that Mr. Severine

has elected to serve a four-year term.

The Mayor stated that Mr. Severine has presented him

with his Certificate of Election for both the two-year

and the four-year.Mayor Rhome said he will put them

on the side, with the four-year being determined that

††††† Mr. Severine will be elected to.

Mayor Rhome informed Mr. Severine that at this time,

as of May 17, 2012, he needs him (Mr. Severine) to

present to him (the Mayor) his Certificates of Affidavit

of Residency.He asked Mr. Severine if he had those

with him.

Mr. Severine replied that he did not.

Mayor Rhome deferred to the Solicitor.

Mr. Severine informed Attorney Derrico that this wasnít

brought up and wasnít in the paper.

Mr. Severine presented his driverís license to Attorney

Derrico.

†††††††††††††††† Mr. Severine informed Mayor Rhome also that this was

†††††††††††††††† not in there.

†††††††††††††††† Mayor Rhome replied that all he is doing is reporting

†††††††††††††††† Article 8 of Section 801, May 17, 2012.

†††††††††††††††† Mayor Rhome asked the Solicitor for his decision.

†††††††††††††††† Attorney Derrico replied that if you canít see the proper

†††††††††††††††† credentials tonight, the swearing in couldnít be done to-

†††††††††††††††† night.

††† †††††††††††† Mr. Severine asked why it wasnít sent to him.

†††††††††††††††† Attorney Derrico informed Mr. Severine that he wasnít

†††††††††††††††† going to answer his question; heís reading right from

†††††††††††††††† the book.

††††††††††† ††††† Mr. Severine replied that this was never told to him, even

†††††††††††††††† when he went to the Borough to get his Certificate.

†††††††††††††††† Attorney Derrico answered that he doesnít know what

†††††††††††††††† he (Mr. Severine) did or didnít do.He said he can only

†††††††††††††††† tell him to read what the book says.

†††††††††††††††† Mr. Bilsky asked if this has ever been asked of an elected

†††††††††††††††† Council person in the past.

†††††††††††††††† Attorney Derrico replied that this was just put in the Code

†††††††††††††††† and enacted on May 17, 2012.

†††††††††††††††† Mayor Rhome asked Attorney Derrico if that was his

†††††††††††††††† decision.

†††††††††††††††† Attorney Derrico answered in the affirmative.He said

†††††††††††††††† that if Mr. Severine provides the Affidavit for the next

†††††††††††††††† meeting he will be seated at that time at Council.

†††††††††††††††† Mayor Rhome stated that this will have to be handled at

†††††††††††††††† next Mondayís meeting.

††††††††††† 2.†† Second Ward

††††††††††††††† Mayor Rhome stated that Second Ward has no positions

†††††††††††††††† open.

3.     Mayor Rhome called on Mr. Paul Sharkady.

Mr. Sharkady informed the Mayor that he did not have

his either.

†††††††††††††††† Attorney Derrico reported that the way he interprets the

†††††††††††††††† Act, a person who runs for an office and has already been

†††††††††††††††† in office does not have to submit that Affidavit.

†††††††††††††††† Mayor Rhome asked if it is correct that Mr. Sharkady is

†††††††††††††††† eligible to have Judge Mark swear him in to office.

†††††††††††††††† Attorney Derrico answered ďYesĒ.

†††††††††††††††† Mayor Rhome asked Mr. Sharkady and Judge Mark to

†††††††††††††††† come forward.

†††††††††††††††† The Mayor stated that Mr. Sharkady has been elected to

†††††††††††††††† serve a four-year term in the Third Ward and a four-

†††††††††††††††† year term At Large.He asked Mr. Sharkady to declare

†††††††††††††††† which position he will accept.

†††††††††††††††† Mr. Sharkady declared that he would take the Third Ward

†††††††††††††††† seat for four years.

†††††††††††††††† Mayor Rhome stated that Mr. Sharkady has chosen the

†††††††††††††††† Third Ward seat (for four years), and the At Large posi-

†††††††††††††††† tion will remain open.

†††††††††††††††† District Judge David Mark administered the Oath of Office

†††††††††††††††† to Mr. Sharkady.

†††††††††††††††† Mr. Sharkady returned to his seat at the Council table.

†††††††††††††††† Mayor Rhome asked him if thatís where he would like

†††††††††††††††† to sit.

†††††††††††††††† Mr. Sharkady replied that he thinks itís up to the Pres-

†††††††††††††††† ident where the Council members sit.

4.     Openings in the Wards

a.          First Ward Ė Two Year Term

Mayor Rhome stated that this has been vacated

††††† by Mr. Severine, as he declared he wanted a

four-year term.

†††††† Mrs. Coleman motioned to appoint John Bevec

†††††† for the two-year term in the First Ward.

†††††† (Attorney Derrico stated that a second to the mo-

†††††† tion is not necessary.)

††††††††††† Mr. Bilsky nominated Mr. Frank Tatano.

††††††††††† Mayor Rhome stated that Mr. Frank Tatano has

††††††††††† been nominated to fill the First Ward seat that

††††††††††† wasnít accepted by Mr. Severine.

††††††††††† Mayor Rhome asked if there were any questions

††††††††††† on the motion.

†††††††††††††††††††††† Mr. Sharkady asked the Solicitor if the Mayor has

†††††††††††††††††††††† the power of voting at the Reorganization Meeting.

†††††††††††††††††††††† Attorney Derrico replied that he does and read the

†††††††††††††††††††††† appropriate information from Section 101, 1003 of

†††††††††††††††††††††† the Code.

b.         Third Ward

Mayor Rhome stated that Mr. Sharkady declared he

††††† was going to accept the four-year term for the Third

††††† Ward of the Borough of Canonsburg Council, which

leaves a vacancy in the At large position four-year

term.

Mr. Bilsky nominated Mr. George Coleman.

Mayor Rhome stated that Mr. George Coleman has

been nominated to fill the At Large position for the

Mayor Rhome stated that Mrs. Coleman makes the

†††††††††††††††††††††† Mr. Severine who was elected by the public, should be

†††††††††††††††††††††† seated before making all the nominations (listed on

†††††††††††††††††††††† the Agenda).

†††††††††††††††††††††† Attorney Derrico replied that Mr. Severine couldnít

†††††††††††††††††††††† be seated because he didnít have his credentials.

†††††††††††††††††††††† Mr. Sharkady motioned to defer the elections of the

†††††††††††††††††††††† At Large people and the other ones until the next

†††††††††††††††††††††† meeting.

†††††††††††††††††††††† Attorney Derrico replied that the elections are al-

†††††††††††††††††††††† ready done.He said someone might make a motion

†††††††††††††††††††††† to reconsider if qualified at the next meeting.His

†††††††††††††††††††††† advised that a person canít bring it up if he voted

5.     Additional Swearing In Ceremony

a.          John Bevec

Mayor Rhome asked Mr. Bevec if he had his

Affidavit of Residency in possession.

Mr. Bevec presented his Affidavit of Residency

††††† to the Mayor.

Mayor Rhome found the Affidavit to be in order

and gave it to the Borough Manager.

The Mayor administered the Oath of Office to

††††† Mr. John Bevec.

Mr. Bevec took his seat at the Council table.

b.         Richard Russo

Mr. Russo was not in the audience tonight.

c.          Mayor David Howard Rhome

Mayor Rhome has been elected to a four-year

term as the Mayor of Canonsburg.Affidavit

of Residency and Certificate for the Election

are in place.Mayor Rhome stated that he was

sworn in today at 12:00 noon by District Judge

David Mark.All forms are in line and are to be

given to the Borough Manager.

None(Newly elected Council Representative John Severine was in the

audience but was not permitted to be seated at the Council table tonight

due to regulations in the Code.)

VI.   NOMINATION FOR PRESIDENT OF COUNCIL:

Mayor Rhome called for nominations for President of Council.

The Mayor called a second time for nominations.

Mrs. Coleman nominated John Bevec for President of Council.

Mayor Rhome asked if there were any other nominations for President

of Council.

There were none.

RESULTS OF THE MOTION:Two Yes, Two No, One Abstain.

Mayor Rhome stated that the vote is two to two with one abstention.He

will cast the deciding vote.

MAYOR RHOME CAST THE DECIDING VOTE FOR MR. JOHN BEVEC TO BE THE PRESIDENT OF BOROUGH COUNCIL IN CANONSBURG, PENNSYLVANIA FOR 2014.

VII.         NOMINATIONS FOR VICE PRESIDENT OF COUNCIL:

Mayor Rhome called for nominations for Vice President of Council.

Mr. McGarry nominated Rich Russo.

Mayor Rhome asked if there were any other nominations for Vice

President of Borough Council.

There were none.

*At this point Mr. Sharkady asked if a person can nominate someone who

hasnít been sworn in to the office.

Attorney Derrico answered ďprobably notĒ.

Mr. McGarry rescinded the nomination.

Attorney Derrico informed the Mayor that the vote for Vice President does

not have to be done tonight.

VIII.      TURNING GAVEL OVER TO PRESIDENT:

Mayor Rhome said he would like to hand the gavel over to Mr. Bevec, who

can then decide what he wants to do with the Vice President position.

Mr. Bevec decided that the following items would be handled at next Mon-dayís meeting (January 13, 2013):

A.      Nominations for Vice President of Council

B.      Nominations for President Pro Tem

C.      Nominations for Auditor

D.      Nominations for Engineer

E.       Nominations for Solicitor

F.       Setting of Bond

G.     John Severine gets his hair cut by Bobby Marks and donated to Locks of Love

H.      Committee Assignments Made by President

I.         Setting of Times and Dates of Meetings

IX.   ADJOURNMENT:

Mr. McGarry motioned to adjourn.

Mrs. Coleman seconded the motion.

The motion was passed unanimously.
